Your acceptance of these Terms of Use for Registered Users

Please read these Terms of Use carefully. These Terms of Use apply to the Springsyple jobs services for registered users and complete the General Terms and Conditions and Privacy Policy. By completing the registration process, you represent that:

In case of conflict between these Terms of Use on the one hand and the General Terms and Conditions and Privacy Policy on the other hand, these Terms of Use will prevail.

Accounts, passwords and security

By completing the registration process, You open an account (including setting up a Springsyple ID and password). You are entirely responsible for maintaining the confidentiality of the information you hold for your account, including your password, and for any and all activity that occurs under your account as a result of your failing to keep this information secure and confidential. You agree to notify Springsyple immediately of any unauthorized use of your account or password, or any other breach of security. You may be held liable for losses incurred by Springsyple or any other user of or visitor to the Site due to someone else using your Springsyple ID, password or account as a result of your failing to keep your account information secure and confidential.

Usernames and passwords are for the sole use of the person to whom they are issued. Passwords must be kept confidential and secure. We may deny access to a username if we reasonably believe that it is being used by an unauthorized person or that the user is breaching these terms and conditions. Concurrent usage of a username is not allowed.

Springsyple cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

Registered persons subscribe automatically to the newsletter.

Disclosure of information

Springsyple may only disclose any information we have about You (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Springsyple’s rights or property, or the rights or property of visitors or users of the Site, including Springsyple’s customers.

Springsyple reserves the right at all times to disclose any information that Springsyple deems necessary to comply with any applicable law, regulation, legal process or governmental request. Springsyple also may disclose your information when Springsyple determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.

You acknowledge and agree that Springsyple may preserve any transmittal or communication by You with Springsyple through the Site or any service offered on or through the Site, and may also disclose such data if required to do so by law or Springsyple determines that such preservation or disclosure is reasonably necessary to (1) comply with legal process, (2) enforce these Terms of Use, (3) respond to claims that any such data violates the rights of others, or (4) protect the rights, property or personal safety of Springsyple, its employees, users or visitors of the Site, and the public.

Limitation of liability

Except where prohibited by law, in no event will Springsyple be liable to You for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if Springsyple has been advised of the possibility of such damages.

If Springsyple is found to be liable to You for any damage or loss which arises out of or is in any way connected with your use of the Site or any Content and/or your use of Sprinsyple’s service and product offering, Springsyple’s liability shall in no event exceed the greater of (1) the total of any subscription or similar fees with respect to any service or feature of or on the Site paid in the six months prior to the date of the initial claim made against Springsyple, or (2) €100.00 (or US$125.00).

You agree that Springsyple will not be liable to you or to any third party for termination of your access to the Site as a result of your violation of these terms and conditions.

Participation to reward system

Any individual of age has on a voluntary basis the right to participate in the reward actions set up by Springsyple. The distribution of rewards for individuals must be considered as an occasional contributions in the framework of services provided to third parties outside the exercise of a professional activity and is therefore limited to maximum 3 consecutive rewards per 12 months period. The distribution of rewards for companies inclusive freelancers is unlimited.

People employed by an organization that list rewarded jobs on Springsyple may not to be allowed by their organization to participate to the rewarding system established by Springsyple regarding to jobs listed by their organization. When an organization does not want to authorize its employee to participate to another reward solution, for jobs it lists on Springsyple, than the one set up by this organization a specific reference will be displayed on jobs covered by this “prohibition”. In this case, we invite staff of this organization to use the reward system set up by their employer.

Payments of reward system

Rewards offered by Springsyple for certain jobs may be paid to the hired candidate and its potential sponsor from the moment the hired candidate performed his first day of work and has been confirmed by his employer. The employers have up to 6 months to confirm the recruitment. Jobs that do not mention a reward are not entitled to any payment of any kind whatsoever from Springsyple. Recipients of a reward must claim their rewards using means provided on the Site within the 24 months following the day Springsyple receives the info from the employer that the hired candidate has performed his first day of work. Unclaimed rewards beyond the end of a 24 months period shall automatically become the property of Springsyple.

You are responsible for the payment information provided to Springsyple. In case of payment to a wrong destination due to an error in the information registered on the Site, Springsyple shall not take any initiative to recover this payment and shall not make any other payment to the recipient of a reward.

Rewards and taxes

Any reward in cash received by a member of springsyple.com from Springsyple, should be considered as occasional contributions for service delivered to third parties outside the exercise of a professional activity. The cash reward may be considered as miscellaneous income and may be subject of a declaration by the beneficiary to the tax authorities of the place where the recipient is required to make its tax return. The recipient of this reward is therefore fully responsible for the declaration of this reward in an appropriate manner in his personal income tax return. In any way, Springsyple shall not be held responsible if the recipient does not comply or not fulfill his tax obligations.

Miscellaneous

If any of the provisions of these terms and conditions are held by a court or other tribunal of competent jurisdiction to be void or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary and replaced with a valid provision that best embodies the intent of these terms and conditions, so that these terms and conditions shall remain in full force and effect.

Changes to these terms and conditions and disputes

Springsyple has the discretion to update these terms and conditions at any time. When We do, We will post a notification on the main page of our Site and/or send you an email (when you have provided us your email address). We encourage Users to frequently check this page for any changes in order to stay informed. Your continued use of the Site and/or your continued use of Springsyple’s product and service offering following the posting of changes to these terms and conditions will be deemed as your acceptance of those changes.

Except in case of contrary provisions of imperative law, Belgian law is applicable to this Terms of Use and the Belgian courts are competent in case of a dispute.
